  • DISTANCE SALES CONTRACT

    ARTICLE 1 – SUBJECT:

    The subject of this contract is the Hotel Accommodation Sales service, the characteristics, sales price and conditions of which are specified below, sold electronically by Konur Hotel to the consumer via the website https://hotelrunner.com, and covers the mutual rights and obligations of the parties in accordance with the provisions of the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.
    ARTICLE 2 – PARTIES:
    On one side, ANKARADAYI TURİZM OTELCİLİK İNŞAAT GIDA SAN. TİC. A.Ş., whose address is MEŞRUTİYET MAH. KONUR SK. NO:7 ÇANKAYA/ANKARA (hereinafter referred to as "Konur Hotel" in this contract), and on the other side, the consumer(s) whose information is given below, have concluded this Accommodation Sales Contract regarding the reservation and accommodation service under the following conditions.

    ARTICLE 3: CONTRACT PRICE AND PAYMENT TERMS
    3.1. The Consumer will pay the Contract price via credit card through the Konur Hotel website or via EFT/wire transfer to the bank accounts specified by Konur Hotel.
    3.2. All services included in the price are detailed on the internet promotional page and the Reservation Document, and services other than these are subject to extra charges.
    In particular, the cost of extra food and beverages, personal expenses, transportation, and all goods and services not included in the scope of the purchased service is NOT included.
    3.3. The Consumer is obliged to pay at least 35% of the contract price as a prepayment at the time of registration, and the balance at least 15 days before the start of the service; at the time of reservation if the hotel check-in date is 7 days or less; and in the case of early booking, promotional and special product accommodation sales, the entire contract price must be paid on the reservation date. If the specified payments are not made within the stated periods, the reservation will be cancelled and 35% of the service fee will be invoiced to the Consumer as a cancellation fee. In addition, the amount taken as a prepayment is taken as a security deposit and is therefore non-refundable.
    3.4. The Consumer agrees and undertakes to pay, in addition to the contract price, the interest, maturity difference, and exchange rate difference that will be calculated and notified by Konur Hotel for credit card payments.

    ARTICLE 4: CANCELLATIONS, TRANSFER AND CHANGES

    4.1. For cancellations and changes to reservations, it is necessary to contact the Support line (+90 312 424 01 57) or send a valid reason to the website www.konurhotel.com.tr
    or notify in writing and/or via a permanent data storage medium.

    4.2. The following rules apply to cancellations and changes:
    1. If the consumer requests a cancellation or change up to 15 days before the arrival date at the facility,
    the full amount will be refunded. The consumer agrees and undertakes to pay Konur Hotel 35% of the total price for cancellations and changes made up to 15-7 days before the arrival date, and the full price for cancellations and changes made less than 7 days before the arrival date, except in cases where the consumer or their immediate family members have illnesses or deaths that prevent them from engaging in their usual activities for 10 days, documented with an official report.
    2. If the consumer wishes to cancel or change the discounted product purchased during the early booking period for any reason, they agree and undertake to pay Konur Hotel 35% of the total price up to 7 days before the arrival date, and the full price for cancellations and changes made less than 7 days before the arrival date. 3. If the consumer wishes to change the dates of their discounted early booking product purchased during the discount period for any reason, they agree that the reservation change will be made at the non-discounted list prices valid on the date of the request. 4. Unless the consumer notifies the hotel in writing of any changes they wish to make to their prepaid reservation at least 7 days before arrival, the accommodation terms and conditions written in this contract and the reservation will be valid. 5. If the consumer does not notify Konur Hotel in writing that they cannot go to/reach the accommodation facility, Konur Hotel has the right to cancel all reservations made on behalf of the consumer at the end of 24 hours after the start date of the stay. No refund will be given to the consumer in such cancellations. 6. Konur Hotel is obliged to fulfill its obligation within the period it has committed to from the date the consumer's order is received. If Konur Hotel fails to fulfill its obligation, the consumer may terminate the contract. In case of termination of the contract,
    Konur Hotel is obliged to return all payments collected to the consumer with legal interest within fourteen
    days from the date of receipt of the termination notice and to return any valuable documents and similar papers that put the consumer in debt.
    7. In cases where it becomes impossible to fulfill the service ordered, Konur Hotel is obliged to notify the consumer in writing or via a permanent data storage medium within three days from the date it learns of this situation and to return all payments collected within fourteen days at the latest from the date of notification.
    8. If Konur Hotel terminates the contract unfairly, it is obliged to return all payments made by the consumer up to that date.
    4.3. Consumer requests for changes other than the date in the reservation will be considered provided that they are notified to Konur Hotel at least 7 days before the start date of the service. Konur Hotel will handle this change request to the extent possible; Konur Hotel cannot be held liable for any objections or obligations arising from unfulfilled change requests.
    4.4. In case of early departure from the hotel, the consumer is responsible for paying the full amount of the contract and agrees and undertakes to pay this amount to Konur Hotel.
    4.5. Refunds arising from payments made will be made to the credit card used at the time of reservation.

    ARTICLE 5: OTHER PROVISIONS

    5.1. The information regarding the accommodation subject to this agreement has been reviewed and evaluated by the Consumer on Konur Hotel's website. The accommodation fee and payment method are visible to the consumer on the website before the reservation is completed, and the consumer chooses one of the payment options at their discretion. The consumer completes the payment by entering their credit card information into the system. The system where credit card information is entered is protected by international security software, and it is not possible for the information to be viewed or copied in any way. However, Konur Hotel has no obligation to pay any penalty or compensation for any damages that the Consumer may suffer as a result of transactions being made through the system using passwords and information obtained by third parties due to viruses or other software on the Consumer's computer or due to the Consumer's negligence, and Konur Hotel has the right to seek recourse from the Consumer for any damages that may arise from these reasons. 5.2. It is the duty of a consumer acting in good faith to notify the authorized person in writing of any issues they are complaining about during the performance of the service. If the consumer uses the service until the end without notifying Konur Hotel authorities of any issues they are complaining about, this eliminates their right to compensation, such as substitute services and refunds, regarding the issues of complaint.
    5.3. Even if the consumer has not been able to sign this hotel reservation contract for any reason, by mail order, virtual POS, bank transfer or EFT, they have learned the terms of this contract, which will be valid between the parties, through catalogs, websites or advertisements, and have undertaken to accept this hotel reservation contract under the written terms in this contract.
    5.4. The consumer undertakes that they have read and signed this contract after obtaining all information about the hotel mentioned in this contract from Konur Hotel's web addresses and conducting all necessary research.
    5.5. If the hotel is not checked in without cancellation, the accommodation fee will not be refunded. In cases of force majeure such as death, illness, or accident, if documented, the fees for the unstayed periods will be refunded. For any reason other than these, if you arrive late or depart early, the fees for the remaining periods will not be refunded.
    5.6. Identity and age checks are performed upon arrival at the facility. If there is a difference due to incorrect or incomplete information, it will be collected at the time of arrival.
    5.7. The dates of stay, the names of the persons staying, the type of facility and room, and the accommodation system are clearly stated on the promotional page published on the Konur Hotel's website, which is an annex and integral part of this agreement, and in the reservation records made by the consumer.
    5.8. The consumer will stay between the dates specified in the reservation.
    Outside of these dates, if the facility is available, the consumer can extend the stay after making a request and payment to Konur Hotel for the extension.
    5.9. Konur Hotel is not responsible for any loss and/or damage to the consumer's accommodation or theft of valuable items.
    5.10. Consumers hereby accept, declare, and undertake that, regardless of their arrival time, room occupancy may be possible no earlier than 14:00, and that on the day of departure, rooms must be vacated no later than 12:00, regardless of the departure time, and that the costs of any extra food and beverages and non-system services received at the facility are their own responsibility.
    5.11. Consumers who do not have a signature on this contract but participate in the service subject to this contract are deemed to have accepted and undertaken the terms of this contract by having the person they have authorized to register on their behalf read and sign this contract. Konur Hotel reserves the right to recourse against other consumers for the collection of any excess amount or service fee paid to the persons who have signed this contract.

    5.12. The consumer acknowledges and declares that they have received, read, and are aware of all preliminary information regarding the product/service subject to the contract, its characteristics, sales price, payment method, performance, and other details, and that they have provided the necessary confirmation electronically. Konur Hotel is liable to the consumer for any defects in the service subject to the contract. 5.13. Invoices are sent to the address specified by the consumer in the billing address section during the reservation process. If the billing address section is left blank, the invoice will be sent to the contact information address. Konur Hotel is not responsible for any undelivered invoices resulting from incorrect address information, failure to specify the recipient, or the inability to locate the recipient at the specified address.

    5.14. Child discounts are valid when staying in the same room as the parent. In reservations for families with children, the child's age declared by the Consumer is taken into account. However, if a difference is found between the age declared by the Consumer and the age on the child's ID requested by the facility staff during check-in, the price difference will be paid by the Consumer to Konur Hotel and the necessary change will be made.
    5.15. Adverse weather conditions, road closures, terrorism, strikes-lockouts, possibility of war, floods, fires, unforeseen technical issues, epidemics, etc. are considered force majeure. Due to such reasons, Konur Hotel may cancel the stay or exchange it with another accommodation facility of the same category and quality in the same region or another region. In such cases, the consumer has no right to compensation.
    5.16. In cases of accommodation advertised and sold with an artist, such as during holidays, New Year's, etc., Konur Hotel reserves the right to change the artist in situations beyond the hotel's control (e.g., due to the artist's illness).
    5.17. The Hotel Reservation/Registration document is an annex and integral part of this agreement and is binding on the parties.

    ARTICLE 6: AUTHORIZED COURT
    In resolving disputes arising from the implementation of this accommodation agreement; the provisions of this agreement and the Law No. 6502 on Consumer Protection and related Regulations shall apply first, and the parties may apply to the Consumer Courts and/or the Consumer Disputes Arbitration Board within legal limits. The authorized court for resolving disputes is the Ankara courts and enforcement offices.

    The consumer acknowledges and declares that they have received, read, and are aware of all the information regarding the characteristics of the service subject to the contract, the sales price, the payment method, and information regarding performance, as written on the promotional page of the website and in the registration (reservation) document, and that they have given the necessary confirmation electronically.
